Return to DiscussionsI believe that nudity on ones own property should be legal.I'd like to think yes and Europe is already decades ahead of the States in terms of public nudity. However, I think Greg makes an interesting point or a good first start - legalizing it on your personal property. Might be a good beginning.Overall, though, I do think public nudity should be legalized; just not lewdness.
It is legal on private property already and within dwellings courts have repeatedly refused to award damages to plaintiffs complaining of seeing through others windows. The exception for your yard and woodlot is that you must not be visible from the streets, from buildings with government functions or civic functions, city surveillance cameras, there must be no right of way traffic and you cannot have a business open to the public or be within certain distance of churches, markets and other businesses depending on where you live. Basically if law enforcement can "see" you (any building with a governance function cops can enter and use at will), from the street, or using a camera, they didn't violate your rights to privacy or require a warrant because they are not on your property or searching it from inside it...which would be illegal and any crimes discovered null because of it. If your neighbors complain the city can send you a letter but without proof (taking picture would be illegal for them) there is not much else for them to do. Some places do have a clothing law that requires clothes inside homes and in yards. How that is enforced I don't know.
Should public nudity be legal?
It is legal in the UK. There are many places where it is not socially acceptable. And the public believe it is illegal. A short while ago about 100 of us went hiking naked in a Scottish forest. It had been arranged beforehand with the forest owners and signs were posted. Nevertheless a passing lady reported us to the police. Quite rightly they took no action other than to advise her we were doing nothing wrong. It might have been different if we'd been walking naked through a town centre (though I don't know what law they would apply). All this has been achieved by being reasonable - balancing our right to be nude against the possibility of upsetting the wider public. Intentionally causing alarm or distress is illegal. So we need to avoid doing that when getting naked in public
I think nudity in your own yard as long as your behaving is a giveme it's your yard as for public nudity beyond the yard i'm all for that even if it was nude cities maybe a few in each state. I think places like key west would be a excellent choice as one i'd move there tomorrow.
